Notice for All Health Care Covered Entities
Does your website reflect the latest Notice of Privacy Practices? Why is this important to you?
First, you are required to post your Notice of Privacy Practices per CFR 164.520(c)(3)(i) – A covered entity that maintains a website that provides information about the covered entity’s customer services or benefits must prominently post its Notice of Privacy Practices) on their website and make the notice available electronically through their website. The majority of covered entities we have reviewed do not update their Notice of Privacy Practices consistently.
The HIPAA Privacy Rule mandates that health care providers distribute a Notice of Privacy Practices to all patients. The Notice of Privacy Practices describes the HIPAA defined patient rights related to use and disclosure of the individual’s health information. Your health care provider and health plan must give you a notice that tells you how they may use and share your health information. It must also include your health privacy rights. In most cases, you should receive the notice on your first visit to a provider or in the mail from your health plan. You can also ask for a copy at any time.
Failure to maintain an accurate Notice of Privacy Practice leaves your entity out of HIPAA Compliance.
